Jagan case politically motivated

Hyderabad, May 27, 2013: Describing as politically motivated the case against YS Jagan Mohan Reddy, YSR Congress has said that the legal provisions are being mishandled in this case.  

“The right of opportunity to be heard was denied to Jagan in the case and there was a disproportionate use of investigation agencies,” party senior leader DA Somayajulu told reporters here on Sunday.  

Investigation should be completed within 90 days after filing the FIR and charge sheet should be filed failing which any person is eligible for bail. In this case even after one year the investigation is not completed and five charge sheets were filed against a single FIR which shows the process is shoddy, he said.  

The fairness in the investigation process is hampered as Jagan Mohan Reddy was not given a proper opportunity to be heard and we firmly believe that the case is politically motivated and a larger conspiracy is at work, he said.  

It is the Congress culture to deny bail to the political opponents as towering leaders like Jai Prakash Naryana, Morarji Desai and others were jailed for over 18 months without trial and it shows the vindictive attitude of the ruling party.  

“It is no different in this case and the intent is to carry out political vendetta on Jagan. The investigation has been very slack and lopsided the statements of the investigation agency carry no conviction,” he said.  

CBI has complied the information about YS Jagan Mohan Reddy and his companies from his Income Tax returns and data provided to Registrar of Companies (ROC) and included them in the charge sheets and has no evidence or material of its own, he said.  

First it went on the premise of a highly exaggerated figure of over Rs one lakh crores of misappropriation in the case and a gave a false hype. As days passed and it could not gather enough material to prove its charge, it has scaled down the Rs 43, 000 crores and came further down to Rs 1030 crores.  

The amount specified is not the misappropriation but the value of transactions, which shows the style of functioning of and base of argument of the CBI, he said.  

The first three charge sheets reveal only government policy of YSR and land given in backward areas to leading industrial units for profit(for the govt), while the previous government has given prime land to companies at throwaway prices. The contrast has never been reconciled, he said. 

The second charge sheet deals with the shares issued at a premium which is an accepted norm. The Rs 10 share being issued at a premium for Rs 350 has nothing illegal in it. Eenadu group which has shown a consolidated loss of Rs 1,800 crores has issued shares at a very high premium (Rs 100 share was sold at Rs 5,26,000 a share) which did not attract any law enforcing agencies, he said.  

YSR, who is no more, was named as conspirator in the case, though the Prime Minister and other union ministers were shielded during the recent scams, he said.  

YS Jagan Mohan Reddy completes one year in detention today and we strongly believe that it is a deep  conspiracy that is in full play and the case against our leader is politically motivated.
