HC to decide on Dec 24 on Jagan’s bail
Hyderabad, Dec 20, 2012: The High Court of Andhra Pradesh will deliver its order on Monday on the statutory bail petition of YSR Congress President Sri Y. S. Jagan Mohan Reddy.
Sri Jagan Mohan Reddy filed the statutory bail petition under section 167 (2) of Cr PC seeking bail as the CBI had not filed the charge sheets within the stipulated 90 days after his arrest in the assets case.
Justice B. Seshasayana Reddy reserved his orders for Monday after hearing the arguments of counsel for Sri Jagan Mohan Reddy and CBI and examining the affidavits submitted by them.
During his arguments over the last two days, Jagan Mohan Reddy’s counsel Niranjan Reddy and Padmanabha Reddy disputed the claim of CBI that his client was arrested in the VANPIC case.
During the arguments on Wednesday, CBI informed the court that Sri Jagan Mohan Reddy was arrested in VANPIC case and investigation in other cases was yet to be completed. “No bail should therefore be given to him,” CBI counsel argued.
This was quite contrary to the arguments of CBI counsel who told Justice Samudrala Govindarajulu on Sept 26 that Sri Jagan Mohan Reddy had no role in the VANPIC case.
Padmanabha Reddy informed the court that no statutory bail petition was filed in the Supreme Court by his client earlier under the provisions of section 167(2). “No arguments took place in the Supreme Court on such a petition. He didn’t file such a petition as the 90 days’ period had not lapsed when he filed the petition in the Supreme Court,” he told the court, adding that the CBI counsel was misleading the court.
Justice Seshasayana Reddy asked the CBI on Wednesday whether it had informed the Supreme Court the grounds on which he was arrested and the cases on which the investigation was yet to be completed.
Sri Jagan Mohan Reddy’s counsel submitted his arrest memo and remand report to HC in which there was no mention of VANPIC case and told the Court that CBI was simply misleading the Court to deny bail to his client.
