CBI court dismisses charges against Jagan

Hyderabad, May 14,
2013: In a major development in YSR Congress Chief Sri Y.S. Jagan Mohan Reddy
case, the CBI court at Nampally here on Tuesday dismissed the CBI’s charges of
criminal breach of trust and corruption mentioned in the fifth charge sheet against
him under section 409 of the IPC and section 12 of the Prevention of Corruption
Act respectively.

While taking cognizance
of the fifth charge sheet filed by the CBI against the Dalmia Cements in the
case, the CBI court rejected the charges against him saying there are no
grounds to say that Sri Jagan Mohan Reddy had resorted to criminal breach of
trust and corruption.

“The 2 sections, under
which the CBI filed the charges sheets, are, however, not applicable in his
case,” the court ruled.

It may be recalled the
CBI court had taken cognizance of the same charges against him in the earlier 4
charge sheets filed by the CBI. The question that arises now is: Will the CBI
court’s cognizance of the same charges in the earlier four charge sheets stand
legal scrutiny in the higher courts?
